1. Service Description

Payenx provides virtual card services that allow you to create and manage digital payment cards for online subscriptions and digital services. Our services include:

• Virtual card creation and management
• Card top-up and balance management
• Transaction monitoring and spending insights
• Card controls (freeze, limits, deletion)

2. Eligibility & Account Registration

You must be at least 18 years old and capable of forming a binding contract to use the Services. When creating an account, you agree to provide accurate, complete, and current information. You are responsible for safeguarding your password and for all activities that occur under your account.

3. Fees and Payments

Our fee structure is as follows:

• Card Creation: A fee is charged per virtual card created
• Top-up: A percentage fee is charged on each top-up
• Spending: No fees are charged on transactions
• Monthly Fee: None

Fees may vary by region and are subject to change. Current fees are displayed before you confirm any transaction. All fees are non-refundable unless required by law.

4. Acceptable Use

You agree to use the Services only for lawful purposes. You must not:

• Use virtual cards for illegal transactions or money laundering
• Provide false identity or verification information
• Attempt to circumvent spending limits or security measures
• Share your account credentials with others
• Use the Services in violation of any applicable laws
• Engage in unauthorized reselling of cards or services

5. Card Usage

Virtual cards issued through Payenx are for online use only. Cards are accepted wherever Visa/Mastercard is accepted online. You are responsible for ensuring sufficient balance before making purchases. Declined transactions due to insufficient funds are your responsibility.

6. Refunds and Disputes

For transaction disputes with merchants, you should first contact the merchant directly. If unresolved, contact our support team for assistance. Refunds from merchants will be credited back to your card balance. Top-up fees are non-refundable.

7. Account Suspension

We may suspend or terminate your account if we detect:

• Fraudulent or suspicious activity
• Violation of these Terms
• Chargebacks or payment disputes
• Identity verification failures
• Legal or regulatory requirements

8. Privacy

Your use of the Services is subject to our Privacy Policy, which explains how we collect, use, and share your information. By using the Services, you consent to our data practices as described in the Privacy Policy.

9. Disclaimer of Warranties

The Services are provided "as is" and "as available" without warranties of any kind. Payenxdoes not warrant that the Services will be uninterrupted, secure, or error-free. We are not responsible for merchant issues, declined transactions, or third-party service failures.

10. Limitation of Liability

To the maximum extent permitted by law, Payenx shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Services. Our total liability shall not exceed the fees you paid in the 12 months preceding the claim.

11. Termination

You may close your account at any time. Upon closure, any remaining card balance will be processed according to our refund policy. We may terminate your account for violation of these Terms or for any reason with reasonable notice.

12. Changes to These Terms

We may modify these Terms from time to time. Significant changes will be communicated via email or through the Services. Your continued use after changes become effective constitutes acceptance of the revised Terms.

13. Governing Law

These Terms are governed by the laws of the jurisdiction in which Payenx operates. Any disputes will be resolved through binding arbitration or in the courts of that jurisdiction.
